These Terms & Conditions apply when you use www.evercuriouswhisky.com (the “Website”) or purchase products from us.

The Website and Ever Curious brand are operated by Fruitful Spirits Ltd (“we”, “us” or “our”).

1. Age restriction

We sell alcoholic products and you must be 18 years of age or over to purchase alcohol from us.

By placing an order, you confirm that you are at least 18 years old.

We may use age-verification measures when processing an order. Proof of age may also be required when your order is delivered.

Our delivery partners may operate a Challenge 25 policy. If the person accepting delivery appears to be under 25, they may be required to provide acceptable photographic identification showing that they are 18 or over.

Alcohol will not be delivered to anyone who is under 18 or where satisfactory proof of age cannot be provided.

2. Products

We take reasonable care to ensure that product descriptions, photographs, ABVs, bottle sizes and other information displayed on the Website are accurate.

Packaging, labels and colours may vary slightly from photographs displayed on screen.

Availability is subject to stock.

3. Prices and VAT

Prices displayed to UK consumers on the Website are in pounds sterling and include VAT where applicable.

Any delivery charges will be clearly shown before you place your order.

We take reasonable care to ensure prices are correct. If we discover an obvious pricing error before accepting your order, we will contact you and give you the option to proceed at the correct price or cancel the order for a full refund.

4. Placing an order

When you place an order, you are making an offer to purchase the products in your basket.

You will receive an email acknowledging your order. This acknowledgement does not necessarily mean that we have accepted your order.

A contract between you and us is formed when we confirm that your order has been accepted or dispatched.

We reserve the right to refuse or cancel an order where reasonably necessary, including where:

  • a product is unavailable;

  • payment cannot be authorised;

  • we reasonably suspect fraud;

  • age-verification requirements have not been satisfied;

  • there has been an obvious pricing or product-description error; or

  • accepting the order would breach applicable law.

If we cancel an order after payment has been taken, we will refund the relevant amount.

5. Payment

Payment must be made using one of the payment methods offered at checkout.

Payment is processed through our payment provider. We do not normally receive or store your complete payment-card details.

6. Delivery

Available delivery options, charges and estimated delivery times will be shown during checkout.

Delivery times are estimates unless we expressly agree otherwise.

You are responsible for providing an accurate and complete delivery address.

Because our products contain alcohol, deliveries may be subject to age verification.

If delivery cannot be completed because satisfactory proof of age is not provided, or because there is no eligible person available to accept an age-restricted delivery, additional delivery or return charges may apply where permitted by law.

Please inspect your order when it arrives and contact us promptly if anything is missing or damaged.

7. Your right to cancel

If you are a UK consumer purchasing online, you will normally have a legal right to change your mind and cancel your purchase within 14 days after receiving the goods, subject to applicable exceptions.

To exercise your right to cancel, contact us clearly stating that you wish to cancel your order.

You must normally return cancelled goods within 14 days after notifying us of your cancellation.

Unless the goods are faulty, damaged, incorrectly supplied or we agree otherwise, you will normally be responsible for the direct cost of returning the goods.

You should take reasonable care of products while they are in your possession.

Certain statutory exceptions to cancellation rights may apply. Nothing in these Terms limits any cancellation rights you have under applicable consumer law.

8. Refunds

Where you validly cancel an order under your statutory cancellation rights, we will refund amounts due to you in accordance with applicable law.

Refunds will normally be made using the same payment method used for the original transaction unless otherwise agreed.

We may be entitled to make a deduction where the value of goods has been reduced as a result of handling beyond what would reasonably be permitted when examining goods in a shop.

9. Faulty, damaged or incorrect products

If a product is faulty, damaged, not as described or you receive the wrong product, please contact us as soon as reasonably possible.

Your legal rights in relation to faulty or misdescribed goods are separate from your right to change your mind.

Nothing in these Terms affects your statutory consumer rights.

10. Intellectual property

All content on the Website, including the Ever Curious name and branding, designs, text, photographs, graphics and other material, is owned by or licensed to Fruitful Spirits Ltd unless stated otherwise.

You may use the Website for your personal, non-commercial use.

You may not reproduce, commercially exploit or distribute our Website content without our permission except where permitted by law.

11. Acceptable use

You must not knowingly misuse the Website, introduce malicious software, attempt unauthorised access to the Website or its systems, or use the Website for unlawful purposes.

12. Website availability

We aim to keep the Website accurate and available but cannot guarantee that it will always operate without interruption or error.

We may update, change or temporarily suspend parts of the Website where reasonably necessary.

13. Our liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

If you are a consumer, we are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for business losses suffered by consumers, including loss of profit, business, business opportunity or business interruption.

Nothing in these Terms excludes or restricts rights or remedies that cannot lawfully be excluded or restricted.

We process personal information in accordance with our Privacy Policy and Cookie Policy, available on the Website.

15. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes to our business, Website or applicable law.

The Terms applying to an order will normally be those in force when the order was placed.

16. Governing law

These Terms are governed by the laws of England and Wales.

If you are a consumer resident elsewhere in the UK, you may also have the benefit of mandatory protections provided by the laws applicable where you live.

Nothing in this section deprives you of mandatory consumer protections or your right to bring proceedings in a court that has jurisdiction under applicable law.
